(“Afino,” “we,” “us,” or “our”) collects, uses, shares, and protects information about you when you access or use our platform, website, and related services, including the Shift platform available at shift.afino.ai (collectively, the “Platform”).

By using our Platform, you agree to the terms outlined in this Policy. If you do not agree, please do not use our Platform.

Personal Information: Identifying information you or your employer provide, including your name, email address, phone number, mailing address, and employment and onboarding records.

Financial Information: Transaction data, payment details, and financial records necessary for providing our services.

Cookies and Tracking Technologies: Data collected through cookies, web beacons, and similar technologies to enhance your experience and analyze usage.

2. How We Use Your Information

Providing Services: To deliver and improve the Platform and related offerings, including employee onboarding, training, and compliance workflows.

Communications: To send you account-related communications, such as account setup links, sign-in links, and notifications about Platform activity, by email or text message (see Section 4).

3. Data Sharing and Disclosure

Afino reserves the right to share your information as follows:

With Service Providers: We may share your information with third-party service providers that assist us in delivering and improving the Platform, such as payment processors, customer support, analytics providers, and communications providers.

With Third-Party Applications: The Platform integrates with third-party applications, and using these may require us to share your information with those applications to deliver our services. By using our Platform, you agree to the terms and policies of these third-party providers.

With Your Employer: Because the Platform is provided to you through your employer or prospective employer, information you submit through the Platform may be shared with that organization.

For Legal Purposes: We may disclose your information as necessary to comply with legal obligations, protect our rights, investigate fraud, or respond to government requests.

Business Transfers: In the event of a merger, acquisition, reorganization, or sale of assets, we reserve the right to transfer your information as part of the transaction.

Notwithstanding anything above, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with, or sold to, any third parties.

4. SMS / Text Messaging

Shift sends account-related text messages (SMS) to users of the Platform, such as account setup links, sign-in links, and notifications about onboarding tasks, documents, and other Platform activity.

You consent to receive these messages by providing your mobile phone number and checking the box agreeing to receive text messages from Afino, Inc. Consent to receive text messages is not a condition of employment or of using the Platform; the same information is available by email and within the Platform.

Message frequency varies. Message and data rates may apply.

You can opt out at any time by replying STOP to any message, after which you will receive a single confirmation message and no further texts. Reply HELP for help, or contact us at support@afino.ai.

Your mobile telephone number, SMS opt-in status, and consent records are used solely to deliver the messages described above. They are not shared with, or sold to, any third parties or affiliates for marketing or promotional purposes.

5. Retention of Information

We retain your information for as long as necessary to fulfill the purposes outlined in this Policy or as required by law. We may retain anonymized or aggregated data indefinitely.

6. Data Security

Afino employs reasonable and appropriate security measures to protect your information from unauthorized access, alteration, or disclosure. However, we cannot guarantee absolute security and are not liable for unauthorized access to your information.

7. Your Privacy Choices

You may limit the data you provide; however, certain information is essential to our ability to provide you with services. You may also:

Opt Out of Text Messages: Reply STOP to any text message from Afino to stop receiving texts (see Section 4).

Opt Out of Marketing Communications: You can unsubscribe from marketing emails by following the instructions in those emails.

Limit Cookies: You may set your browser to limit cookies, but this may affect your experience on our Platform.

Afino reserves the right to continue using and sharing your information as necessary for legitimate business purposes, even if you choose to limit certain aspects of data sharing or collection, subject always to the SMS carve-out in Sections 3 and 4.

8. Third-Party Websites and Services

Our Platform may link to third-party websites or applications for convenience and functionality. We are not responsible for the privacy practices or content of these third-party websites or services. Your interactions with these services are governed by their respective privacy policies.

9. Children’s Privacy

Our Platform is not intended for use by individuals under the age of 13, and we do not knowingly collect information from children under 13. If we learn that we have collected information from a child under 13, we will delete it promptly.

10. International Data Transfers

Your information may be transferred to, processed, or stored in a country other than the one in which you reside, including the United States. By using our Platform, you consent to such transfers.

Afino reserves the right to modify this Policy at any time, with or without notice. Any updates to the Policy will be effective immediately upon posting. Your continued use of the Platform constitutes your acceptance of the revised Policy.
